Terms and Conditions – Mit Nissebrev
These terms apply when you buy on mitnissebrev.dk. Please read them before you order. You can save or print this page at any time.
This English version is provided for customers of the Danish site. Danish law applies to the agreement (see section 16). If the Danish and English versions differ, the wording that is most favourable to you applies.
1. Who is selling
AKopensky & Co. (Danish sole proprietorship) CVR (company reg. no.): 38205374 Address: Sluseholmen 37, 2450 København SV Email: kontakt@mitnissebrev.dk Phone: +45 71 62 55 22
We are VAT-registered in Denmark. "We" and "us" in these terms means AKopensky & Co.
2. What you can buy
- Nisse-pakken (the Nisse Pack): a digital Christmas advent calendar with 24 personal letters from the nisse (Christmas elf) to your child, opened one door at a time in December on the website. Your child can reply to the nisse with drawings and short texts that you upload. The replies do not change the story – they are kept as a keepsake for you.
- Printpakke (Print Pack): a PDF file with printable material. It is an add-on to the Nisse Pack.
- Gift codes: a code that can be used to buy the Nisse Pack (see section 8).
- Fest-pakke (Party Pack) and visits by Julemanden (Father Christmas) – Denmark only: DJ, nisse costumes, photographer and home visits by Father Christmas. These are not sold in the web shop; they are agreed by phone and invoiced (see section 10).
Our products are meant for parents and other adults. An adult always creates the profile and makes the purchase. Children never create an account themselves.
3. Prices
All prices are in Danish kroner (DKK) and include 25% Danish VAT. There are no fees or delivery charges beyond the price shown.
| Product | Price |
|---|---|
| Nisse Pack (ordered up to and including 3 December) | DKK 199 |
| Nisse Pack (ordered from 4 December) | DKK 99 |
| Print Pack (add-on) | DKK 49 |
If you order from 4 December, you get access to the calendar from the day you order. All doors for days that have already passed can be opened straight away, so the child can read the letters from the earlier days.
The price of a Party Pack or a Father Christmas visit is stated in the written offer we send you.
4. Payment
You pay in the web shop by card or MobilePay. Payments are processed by our payment provider Stripe. We do not see or store your card details. The amount is charged when we confirm your order, because you get access straight away.
5. How the contract is made
- You choose a product, create a profile with your email and a PIN code, and go to checkout.
- Before paying, you must tick a box to consent to us delivering the digital content immediately and to confirm that you thereby lose your right of withdrawal (see section 7).
- The contract is made when payment is completed.
- We send an order confirmation to your email. It includes these terms and a confirmation of your consent to immediate delivery and that your right of withdrawal has been lost.
Contact us straight away if you do not receive the order confirmation or if something in it is wrong.
6. Delivery and access
- You get access to your profile and the calendar immediately after payment.
- Letters open day by day in December. The Print Pack can be downloaded from your profile.
- The calendar needs an internet connection and a normal, up-to-date browser.
- Access applies to the Christmas season you bought it for. Your child's replies are deleted automatically on 31 December unless you choose "Keep profile" (see our privacy policy).
- On 24 December we email you "Julebogen" (the Christmas Book) with all the letters and your child's replies, as a keepsake.
7. Right of withdrawal
7.1 Digital content (Nisse Pack and Print Pack)
When you buy online you normally have a 14-day right of withdrawal. For digital content not supplied on a physical medium, the right of withdrawal is lost once supply has begun with your prior express consent, you have acknowledged that you thereby lose the right of withdrawal, and we have confirmed this to you (Danish Consumer Contracts Act – forbrugeraftaleloven – section 18(2)(13)).
Because you get access straight away, we ask you at checkout to tick a box next to this text:
"I want access immediately and consent to the supply of the digital content starting now. I understand that I thereby lose my 14-day right of withdrawal."
You cannot complete the purchase without ticking the box. The confirmation is included in the order confirmation.
7.2 Our 24-hour money-back promise (voluntary)
Even though the statutory right of withdrawal has been lost, you can press the "Cancel purchase" button in your profile within 24 hours of buying. You will get the full amount for the order back, no reason needed, and access to the calendar will be closed. We start the refund immediately to the payment method you used. It may take a few banking days before the money is in your account.
This promise is a voluntary offer from us. It does not limit your statutory rights.
7.3 Gift codes
If you buy a gift code, you can withdraw from the purchase within 14 days, as long as the code has not been used. Email kontakt@mitnissebrev.dk. You will get the full amount back no later than 14 days after we receive your message.
7.4 Party Pack and Father Christmas visits
See section 10.
8. Gift codes
- A gift code can be used to buy the Nisse Pack on mitnissebrev.dk.
- The code is valid until and including 24 December of the season it was bought for. The expiry date is shown on the code and in the purchase confirmation.
- If the code has not been used by 24 December, we will refund the purchase price to the buyer if the buyer contacts us no later than 31 January of the following year.
- Apart from that, the code cannot be exchanged for cash and can only be used once.
- Look after the code like cash. Contact us if it is lost and we will help if we can see that it has not been used.
9. Referral codes
After buying, you get a referral code that you can share with family and friends yourself. Whoever buys the Nisse Pack with the code gets the Print Pack free of charge (the price of the Nisse Pack does not change). One code can be used per order. As a thank-you you can earn a discount for next Christmas (Nissevenner): it depends on how many families bought with your code and is issued as a single-use code on 28 December, valid until 30 November the following year. It cannot be combined with other discounts or exchanged for cash. We never contact your friends – you decide whether and with whom to share the code.
10. Party Pack and Father Christmas visits (Denmark only)
10.1 Ordering
You can send an enquiry on the website. We then call you, if you have asked us to, and send a written offer by email with the service, date, time, address, price including VAT and these terms. The agreement only becomes binding on you once you have accepted the offer in writing (for example by replying to the email). We then send an invoice with 8 days to pay.
10.2 Who performs the service
The services are performed by independent freelancers (e.g. DJ, photographer and Father Christmas) whom we engage. We are your contracting party and we are responsible for the service being delivered as agreed.
10.3 Right of withdrawal
The agreement is made at a distance (by phone and email). In our assessment, these are services related to leisure activities to be performed on a specific date. The statutory right of withdrawal does not apply to such services (forbrugeraftaleloven section 18(2)(12)). Instead, the cancellation rules below apply.
10.4 Cancelling a Father Christmas visit
| You cancel | You get back |
|---|---|
| More than 7 days before the visit | The full amount |
| Between 7 days and 48 hours before the visit | The amount minus DKK 500 |
| Less than 48 hours before the visit | Nothing |
Cancellation must be made in writing to kontakt@mitnissebrev.dk. The time we receive your email is what counts. Cancellation rules for the rest of the Party Pack are stated in the offer.
10.5 If we have to cancel
If we or the agreed freelancer cannot come (e.g. due to illness), we will try to find a replacement. If we cannot, or you do not want the replacement, you get the full amount back. Your other statutory rights also apply.
10.6 Practical matters
Please make sure there is access to the address at the agreed time. Only share the information about your children that is needed for the visit (e.g. first name and age). Do not share health information or other sensitive information.
11. Faults (complaints about defects)
You have the right to complain under the Danish Sale of Goods Act (købeloven) if the digital content or service is not as agreed. The time limit for complaints is 2 years. You must complain within a reasonable time after discovering the fault. Email kontakt@mitnissebrev.dk with a description of the problem.
If the calendar does not work, we will fix the fault as quickly as possible. If we cannot do so within a reasonable time, you may, depending on the circumstances, get a proportionate price reduction or your money back.
12. Your profile, PIN and your child's replies
- You are responsible for keeping your PIN secret.
- Only upload drawings and texts made by your child that do not infringe anyone else's rights and are not unlawful.
- We only use your child's replies to show them in the calendar, send them to you in the Christmas Book and keep them if you choose "Keep profile". We never use them for marketing.
- The letters, illustrations and Print Pack are protected by copyright. You may use and print them privately within your family, but not sell or share them publicly.
13. Liability
We are liable under the general rules of Danish law. Nothing in these terms limits your mandatory rights as a consumer.
14. Personal data
Read how we process personal data in our privacy policy and cookie policy.
15. Complaints
Please contact us first at kontakt@mitnissebrev.dk – we will reply as quickly as possible and try to find a solution.
If we cannot agree, you can complain to:
Nævnenes Hus (the Danish Consumer Complaints Board secretariat), Toldboden 2, 8800 Viborg, Denmark – via naevneneshus.dk. A small fee applies.
If you live in another EU country, you can also get help from the European Consumer Centre Denmark at forbrugereuropa.dk.
The European Commission's online dispute resolution (ODR) platform closed on 20 July 2025 and can no longer be used.
16. Governing law and jurisdiction
The agreement is governed by Danish law. Disputes are decided by the Danish courts. This does not deprive you of the protection you have under the mandatory rules of the country where you live.
17. Changes
We may change these terms for future purchases. The terms that applied when you bought always apply to your purchase.
